Article 1  Purpose and legal basis
    The regulations are formulated in accordance with the Suggestions of Baoshan District on Enhancing Management of Special Fund for Industrial Restructuring and Transformation, in a bid to further implement the Suggestions of Baoshan District Committee of the Communist Party of China on Promoting Cultural Development and Prosperity, as well as to create a better environment to step up the development of cultural and creative industry in Baoshan District（hereinafter referred to as the district）. 

 

Article 2  Source of the guiding fund
   A 30-million-yuan guiding fund for the development of cultural and creative industry is allocated from the district’s annual budget to guide and promote the development of cultural and creative industry, which is subject to adjustments according to annual budget performance.
   Under the principle of level-to-level administration, applications for the guiding fund shall be handled in accordance with the Suggestions of Baoshan District on Enhancing Management of Special Fund for Industrial Restructuring and Transformation. 

 

Article 3  Principles for using the guiding fund
1.  Support the development of industry cluster.
Priority is given to introducing advanced enterprises, activities and enterprises with distinguishing characteristics, practical programs to the district.
2. Priority is given to supporting key or weak areas. Enterprise will be especially funded where they need government support the most; Key industrial park and weak points in industrial development shall be especially supported.
3. Explore new ways to manage and use the guiding fund. Based on the process of using the guiding fund formulated in the “1+9” regulations, namely the Suggestions of Baoshan District on Enhancing Management of Special Fund for Industrial Restructuring and Transformation，and other regulations on the management and use of nine special funds, the district should take practices from other districts as reference and explore new ways to manage and use the guiding fund, which must be in line with basic policies in the district. 

 

Article 4   Range of application
    The guiding fund centers on major, key projects and platform-building projects in cultural and creative industry. Units that apply for the guiding fund must fall into the Category List of Shanghai Cultural and Creative Industry, and their business must be registered with commerce authorities in the district and they must pay tax to tax authorities in the district, and their projects must be in the district. The guiding fund will be used to support the following items:
1. Key industries such as mobile Internet，design (industrial design, architecture design, animation design)，software and information services, media, art, advertising and MICE, consulting services, digital game and publishing, electronic sports shall be funded. Highly innovative and fast-growing industries shall be especially funded.
2. The development platforms of cultural and creative industry accredited by the central and municipal government and the key industrial parks mentioned in the 12th Five-year Plan for the Development of Cultural and Creative Industry in Baoshan District shall be funded. Priority shall be given to enterprises in the cultural and creative industry that are in these platforms or parks.
3. Public service platforms that can greatly promote the development of cultural and creative industry, state-level enterprise design centers, city-level innovative design demonstration enterprises, projects from master studios, and major cultural and creative projects and events at district level shall be funded. 

 

Article 5  Key fund-receiving areas and funding mechanism
1. Support enterprises in the application for government financial support at state and city level to develop cultural and creative industry.
Projects that have received government financial support at state and city level (such as Shanghai Cultural and Creative Industry Fund, Shanghai Software and Integrated Circuit Industry Special Fund, Shanghai E-commerce Promotion Pilot) shall receive the guiding fund from the district government.
2. Support key cultural and creative industries
(1) Support the development of mobile Internet in terms of basic business development and application services. Basic business development includes: developing processing chips that can work on multiple smart mobile terminals; developing multiple mobile terminals such as tablet computer, smart phone, e-book reader; developing optical broadband networks and Next Generation Broadcasting. Application services include: developing terminal operation system，data base, middleware, office software, industry-related software; making breakthroughs in core platform technology such as data mining, mass data processing, billing and access control and developing third-party content platform; Efforts should be made to ensure that mobile Internet can drive production, and improve the quality of life, and set a good example for education and office application industry. Leading mobile Internet enterprises and fast-growing enterprises that are accredited by Shanghai Municipal Commission of Economy and Informatization and Baoshan Economy Committee shall be especially funded. Efforts to ensure special fund and implementation regulations concerning mobile Internet industry will be stepped up to especially support mobile Internet industry.
(2) Support the development of design industry (industrial design, architecture design and animation design). The guiding fund supports especially enterprises and professional design institutions that strive to become a national design center, or creative design demonstration enterprise at the city level or master studio, enterprises that are going international, the exhibition, promotion and corporation of designs, startup design enterprises that are being incubated, as well as institutions of higher learning and training institutions that are providing creative design training.
(3) Support the development of information services, such as software, digital games and publishing. The guiding fund supports especially technology, products and services that can greatly fuel the development of the industry and applications, projects that can help industrial restructuring and upgrading, the development of information industry that involves electronic sports, digital games, net literature, digital short films, digital music, digital films and television programs, animation and digitally published products，software and integrated circuit enterprises that are included in the development plan at state and city level, and the purchase of the right to use or own the technology listed in the Category List of Advanced Imported Technology and Products from foreign enterprises in the concurrent year. The district will also subsidize software enterprises that are accredited by the municipal government and sell software products to general VAT payers based on their actual value-added tax. 

3. Support the introduction and development of key and leading enterprises. Key enterprises are those influential, famous, successful enterprises that are also the driving force for the industry and must be brought in to support the development of cultural and creative enterprises with distinguishing characteristics, key areas and industrial parks, as well as leading innovative enterprises that have new business mode and great potential and are supported by venture capital fund. The enterprises mentioned above shall be funded as follows after they have been brought in to the district.
(1) Key enterprises that have registered in the key industrial parks in the district for the first time with a registered capital of more than 2 million yuan and a rented office space of 500 to 1000 square meters shall receive a subsidy of 20 percent of its rent for three years (no more than 1 million yuan) upon approval. Key enterprises that have registered in the key industrial parks in the district for the first time with a registered capital of more than 5 million yuan and a rented office space of 1000 square meters and above shall receive a subsidy of 20 percent of its rent for three years (no more than 2 million yuan) upon approval. Key enterprises with an office occupancy of more than 5000 square meters shall be subsidized according to regulations in the Suggestions of Baoshan District on Enhancing Management of Special Fund for Industrial Restructuring and Transformation. 

(2) Key enterprises that have purchased an office space of 500 to 1000 square meters and have a registered capital of more than 2 million yuan shall receive a subsidy of 5 percent of the office price, no more than 1 million yuan, upon approval. Key enterprises that have purchased an office space of 1000 square meters and above and have a registered capital of more than 5 million yuan shall receive a subsidy of 5 percent of the office price, no more than 2 million yuan, upon approval. Key enterprises that have purchased office space of more than 5000 square meters in the district shall be subsidized according to regulations in the Suggestions of Baoshan District on Enhancing Management of Special Fund for Industrial Restructuring and Transformation.
(3) Key enterprise’s daily operating expenses including communication fee, server hosting fee shall be subsidized with 20 percent of their 3-year expenses, which is no more than 300,000 yuan upon approval.
(4) Enterprises in the cultural and creative industry that have received awards at state or city level, such as national enterprise design center, creative design demonstration enterprise at the city level, brands and enterprises that have won the “Design Capital Awards”, shall receive 200,000 yuan or 100,000 yuan as a reward.
(5) Financial services companies, organizations and institutions in the district that primarily invest in cultural and creative industry, such as investment company, bonding company and small loan company, and enterprises in the cultural and creative industry that are being reorganized and will go public shall be subsidized according to regulations in the Suggestions of Baoshan District on Enhancing Management of Special Fund for Industrial Restructuring and Transformation. 

4. Support especially the platforms for the development of cultural and creative industry in improving management and output.
(1) The guiding fund shall be used to encourage non-governmental investment in cultural and creative industry park. Cultural and creative industry parks built through non-governmental investment that are rated as a national demonstration base or park shall be rewarded with 1 million yuan. And those rated as a city-level demonstration base or park shall be rewarded with 500,000 yuan.
(2) These platforms shall be evaluated annually in terms of the number of enterprises, the number of registered enterprises, output rate, growth rate, the intensity of leading industries, the performance of public services platforms and enterprise incubators, management and service quality. The top three platforms shall be rewarded with 500,000 yuan, 300,000 yuan and 10,000 yuan respectively.
(3) Master studios at state and city level with a floor space of 300 square meters and above shall receive a 300,000-yuan subsidy upon approval.
(4) The guiding fund shall be used to encourage enterprises and institutions in cultural and creative industry to use creative brand name. Qualified enterprises in cultural industry parks and creative industry clusters are encouraged to use foreign languages and numbers in their brand names. 

 5. Support especially the development of public service and industry platforms.
(1) The guiding fund shall be used to support the development of public service platforms and promotion projects that can provide the cultural and creative industry with information, financial services, trade, technology, cooperation and exchange, industrial communication and connection. The national public service platforms shall receive a fund of 20 percent of their investment, which is no more than 3 million yuan. And city-level public service platforms shall receive a fund of 15 percent of their investment, which is no more than 2 million yuan.
(2) National-and-city-level industry associations and branches of international organizations that can greatly drive the cultural and creative industry in the district shall receive a rent and decoration subsidy of 300,000 to 500,000 yuan upon approval.
(3) Events operated by private enterprises that can drive cultural development and prosperity in the district and are influential in the whole city, such as exhibitions, forums and concerts, shall receive a fund of 15 percent of their cost, which is no more than 2 million yuan. Major events, projects and researches that are specially approved by the district government shall be funded according to district regulations on special fund. 

6. Support private investment in cultural projects like museums and art galleries.
The guiding fund shall be used to encourage private investment in museums (including collection museum, art gallery, exposition, and exhibition hall). Museums (including collection museum, art gallery, exposition, and exhibition hall) with distinguishing characteristics, high quality, and great influence that cover an exhibition area of 300 to 3000 square meters and can fuel the cultural development of the district shall receive a subsidy of 15 percent of their investment upon approval, which is no more than 5 million yuan. Museums with an exhibition area of more than 3000 square meters shall be subsidized according to regulations in the Suggestions of Baoshan District on Enhancing Management of Special Fund for Industrial Restructuring and Transformation.
7. Support key enterprises in talent introduction
   Priority is given to qualified talents in the enterprises in the cultural and creative             industrial parks when it comes to applying preferential policies laid down in Regulations of Baoshan District on the Management and Use of Special Fund for Talents Development and the Regulations of Baoshan District on the Rent Subsidy for Talents.   

 

Article 6   Management system
    Offices in Baoshan Economy Committee, Baoshan District Development and Reform Commission, Baoshan District Commission of Commerce, Science and Technology Committee of Baoshan District and Baoshan District Administration of Culture, Radio, Film and TV that are in charge of cultural and creative industry development manage the guiding fund, including releasing the information of the projects, accepting and examining fund applications, allocating the fund , supervising and evaluating the implementation of the fund, as well as inviting experts to evaluate key platforms and enterprises. 

 

Article 7  Application, examination and approval of the guiding fund
    The application, examination and approval of the guiding fund shall be in accordance with the Suggestions of Baoshan District on Enhancing Management of Special Fund for Industrial Restructuring and Transformation. 

 

Article 8   Management and supervision
    The management and supervision of the guiding fund are stated in the Suggestions of Baoshan District on Enhancing Management of Special Fund for Industrial Restructuring and Transformation. 

 

Article 9  Supplementary articles
1 The regulations shall be subject to any policy adjustments made by higher authorities. One project in one enterprise shall be funded according to one of these regulations that is most beneficial to this project. Projects that have already received other special funds in the district shall not receive the guiding fund in the regulations.
2. Enterprises or projects cannot move out of the district or register outside the district within 10 years once they have been funded, and the violators must return the fund they have received.
3. Baoshan Ecomony Committee and Development and Reform Commission of Baoshan District reserve the right of final explanation for the regulations.
4. The regulations shall enter into force as of the date of promulgation and shall be implemented for three years.
